has gone from fear to shock to anger. our reporter tracked down this mother yesterday. she did refuse to answer any of his questions. on tuesday police say she told them someone tried to steal her toddler from her arms in front of their house. she even helped police make a sketch that put the whole neighborhoods on alert. police became suspicious weather canvassing for witnesses and surveillance video turned up nothing. they focused on the mother after they learned she has a criminal history although they woken give any specifics about that. they are not mincing words about this lie. you can't say enough about somebody who prevents information like this especially when you're dealing with kids. and to think about the lies she created. >> reporter: now it is up to the district attorney down here in santa clara county to decide whether or not to press charges

dragged know that bizarre girlfriend saga of manti te'o. this week he and notre dame officials say he was drawn in a romance online fooling him into believing she died of leukemia back in september. the so call girlfriend lied about being a stanford student, as well. >> in the post-game interviews, you know, you see all this emotion, again in the subsequent follow-up pieces you see all of the talk of this and in most of those pieces 99, the 5% of them, there's no mention of stanford. the girl by the way is very much alive in southern california. te'o now claims he was duped by her. many wonder whether he and notre dame made up the hoax to improve his chances of winning the heisman. he was the runner-up and we are still waiting to hear from him perhaps today. a lot of people thought he might talk yesterday. he is still in hiding. >> like you said, it's a head scratcher. >> it is. because what's the n game? what does he have to gain from this besides maybe sympathy from the heisman voters? but he is going to go on to the

cbs 5 reporter elissa harrington is at a safeway right now in san francisco where apparently they are getting more flu vaccine. >> reporter: good morning. the flu is now widespread throughout california and has already taken the life of a bay area woman. a 98-year-old woman died earlier this month from the flu and pneumonia and this marks the first bay area death from the flu this season. now, four other people in the state have also died from the illness one in the sacramento area, another in the central valley, and two down in southern california. officials with the centers for disease control say this is the worst flu season in 10 years. it is now widespread throughout california and it came early this year. it usually doesn't peak until about february. health officials are urging people to wash their hands, cover coughs and get a flu shot. >> they really should see their physician. there are other things that they can do. there are antiviral drugs such as tamiflu that can be used to help treat those people that

have been exposed or who are at higher risk for complications of flu. >> reporter: getting the vaccine, however, is the best way to avoid getting sick. it has a 62% level of effectiveness. safeway just shipped 200,000 doses of the vaccine to its pharmacies and we're outside the safeway here in san francisco on king street. you don't have to make an appointment to get a vaccine. you can walk in during business hours first come, first served. elissa harrington, cbs 5. the bay area millionaire murdered in his own mansion may be a victim of the money team a notorious east oakland street gang. the "chronicle" is reporting that ravi kumra was killed not long after a prostitute revealed details about his on length monte sereno home to money team members. two of the three accused killers are believed to have ties to that gang. san jose police chief chris moore will officially retire when his shift ends today. he announced last fall that he planned to retire after two years as chief. he has since expressed

frustration at city budget cuts that have prompted many officers to find jobs in other cities. city manager deborah figone announced last week she is extending the search for a replacement. deputy chief larry esquivel is interim chief. one of chief moore's final actions happened yesterday when he turned dunn a request boy casino m8trix to have gambling facilities on the 8th floor. chief moore followed the advice of sjpd's gaming administrator who determined multilevel gambling could present security problems. state agency is investigating the ship pilot who was at the helm of the empty oil tanker when it sideswiped the bay bridge a few weeks back. they hit the tower closest to yerba buena island on january 7 and now the california board of port commissioners could recommend that guy kleess his license be suspended or revoked. the state probe is expected to take 90 days. other incidents since 2009 two of which were deemed pool error. around the bay, the man convicted of killing two people at the richmond/san rafael bridge toll plaza is expected to be sentenced today. investigators say nathan burris shot and killed his former girlfriend and her friend back in 2009. the jury gave burris the death penalty. san francisco's new nudity ban still in place this morning. a federal judge heard a challenge yesterday from activists claiming it violates their personal freedom. the judge refused to rule. he says he will consider their arguments and issue a ruling before the city's ban goes into effect on february 1. 5:10 now. bad batteries, a team of u.s. investigators is looking into those dreamliners' biggest problems. >> forget chocolates and flowers. how one man impressed a girl by holding his breath. >> and gramk video -- >> and dramatic video out of australia. the latest in the fight against their massive wildfires coming up.

homes. the man's body was found brush fires in australia have killed one man and destroyed several homes. the man's body was found in a burned-out car in a small town a little east of melbourne. also several exhausted firefighters collapsed from the heat today with temperatures up

right now up and down the nimitz freeway near oakland airport. southbound 880 moves fine even past the airport towards 92 and hayward. they still have the roadwork in lanes. we just talk to caltrans. it's in the eastbound lanes of the dumbarton bridge out of menlo park. earlier, our sensors were picking up a little bit of slowing right now again just in the eastbound direction. bart on time. that is traffic. here's lawrence with the forecast. >> a lot of clear skies around the bay area this morning, hazy in spots, chilly temperatures in the valleys back down to freezing and below once again. at the coast fairly mild this morning. temperatures in the 30s and 40s in most areas right now. it looks like by the afternoon enjoying hazy sunshine and moving well into the 60s and sunshine all the way to the coastline for today. that big ridge of high pressure continues in control. and it's going to sit here today and through the weekend. so a lot of sunshine and the temperatures running above

average for this time of year. so with that in mind, looks like some great weather and some folks may be going to the beach but watch out. we have had some big time storms off the coastline that have generated some large swells that's approaching the coast. high surf advisory up for the weekend. we could see some of these waves up to 20 feet so be very, very careful as you head to the coastline. some of those could sweep you away in a hurry. in the meantime traveling around the state, sunshine in the valley. 47 degrees and patchy fog in eureka today. around the bay this afternoon, 65 campbell and san jose and 66 degrees in redwood city. east bay numbers sneaking up into the 50s and low 60s. and inside the bay we'll find those temperatures running in the 50s and 60s too. about 64 degrees in richmond. 63 in oakland. and 62 in san francisco. looking out over the next couple of days, the weekend you have some plans go to it. lots of sunshine coming your way. enjoyable weather through monday and tuesday. ah, yeah, but by the middle of

hobbit movie. 12 people were killed and dozens more wounded in the aurora theater last july during a midnight screening of the latest batman sequel. authorities in chicago plan to exhume the body of a lottery winner today in an effort to determine how he was poisoned. the man won $425,000 in a lottery last summer but died right before he was about to collect the money. he was poisoned with cyanide. there are no suspect in the case. some top republicans in congress are considering a short-term increase of the debt ceiling. house budget committee chairman paul ryan says they are wag the benefits of an extension as a way to get the senate and white house engaged in future conversations. the president has warned that if congress does not raise the debt ceiling the economy could crash and there could be delays for social security checks and veterans' benefits. things that men will do to i am privilege women. an aussie free diver says he got into the sport to win over a few girls at the public to

an apartment building on lewis road. luis ricardo hernandez worked at the apartment building. his attorney says hernandez acted after police did not respond to recent auto burglaries there. well, imagine if you stumbled upon a burglary happening in broad daylight. what would you do? ford frazier of the redwood heights section of oakland said he was nearly shot by burglars when he tried to call for help. tuesday afternoon, he saw three men across the vote trying to break in his neighbor's house. he called 911 and waited on hold as the machine tried but failed to get -- as the men tried but failed to get inside that home. >> i'm standing here on the phone, they are across the street getting in the car and the guy shot at me and the bullet had the the wall. see that black mark? >> well, the burglars got away. frasier said he was on hold for 10 minutes or so. the burglars did get away. he was on hold.
